435 NORTH MICHIGAN AVENUE CONDOMINIUM ASSOCIATION INDEMNIFICATION FORM

To the fullest extent allowed by law and in consideration for permission to allow the undersigned event attendee ("Event Attendee'') to attend certain event ("Event") at the premises located at 435 North Michigan Avenue, Chicago, Illinois ("Premises") pursuant to the written agreement between the undersigned and 435 North Michigan Avenue Condominium Association ("Association") and unit owner (“Unit Owner”), the Event Attendee hereby agrees as follows:

(1) Indemnity. Event Attendee shall indemnify, defend, and hold harmless the Association, its Board of Directors ("Board"), and employees and agents (including without limitation its managing agent), and agents and employees of any of them, and unit owner hosting the event (“Unit Owner”) (collectively, the "lndemnitees"), from and against any claims, suits, liability, injury (to person or property), damages, losses, expenses (including but not limited to attorneys' fees and costs) (collectively, "Claims") relating to or in any way arising from or appertaining to, directly or indirectly, the actions, by Event Attendee, or anyone for whose acts Event Attendee may be liable in relation to or arising out of Event Attendee’s presence at the Premises, regardless of whether or not such claim, damage loss or expense is caused in part any of the Indemnitees. Event Attendee shall further indemnify, defend, and hold harmless the Indemnitees from and against all Claims relating to bodily injury, sickness, disease or death, or to damage to or destruction of property (including loss of use thereof), caused by or in connection with any act of omission of Event Attendee, or anyone for whose acts Event Attendee may be liable. If any person, organization or entity asserts a claim or institutes a suit, action, or proceeding against any Indemnitee arising out Event Attendee's actions or inactions, the Event Attendee, upon request of the Indemnitee, shall promptly assume the defense of such claim, suit, action or proceeding, at the Event Attendee's expense; and the Event Attendee shall indemnify and hold harmless the Indemnitees from and against all liability, loss, damage, cost and expense (including attorneys' fees) arising out of or related to such claim, suit, action, or proceeding.
